In February 2011, Senator Mike Shirkey introduced bill 431 to the Senate Regulatory Reform Committee. Entitled the Lawful Internet Gaming Act, the bill sought to authorise and regulate online gaming under the License and Regulation Act 1993 and the Michigan Gaming Control and Revenue Act 1996.

The proposed legislation stated that any person aged 21 or above located within the state of Michigan would be permitted to place a wager using an “internet horseracing wagering machine” or to play “internet gaming.” Licensed operators would be required to pay a $10 million application fee, as well as a 15% tax on net winnings derived from internet gaming.

After passing through the Senate Regulatory Reform Committee, SB 431 was reported favourably in April 2011. However, the bill stalled at the full Senate stage and did not progress any further.


Eight years after Sen. Shirkey presented his Lawful Internet Gaming Act, Rep. Robert Kosowski introduced a similar piece of legislation in the Michigan House of Representatives. On March 4, 2014, Kosowski filed HB 4927, entitled the Lawful Internet Gaming Act. Like SB 431, the bill aimed to create licences for operators to run internet horseracing wagering machines and internet gaming sites.

HB 4927 stated that anyone aged 21 or above located within the state of Michigan would be entitled to use an IGW machine or play igaming. The bill passed through the House Regulules committee in July 2014 and was reported favourably. However, it did not advance past the House Finance subcommittee.


Two years later, the issue of online gambling was addressed as part of a broader package of legislative amendments. On April 6, 2016, the Lawful Internet Gaming Act was inserted into House Bill 4308, which contained proposals to amend the Michigan Gaming Control and Revenue Act.

HB 4308 was approved by the House on May 12, 2016. It passed through the Senate on June 1, 2016, and was eventually signed into law by Governor Rick Snyder on December 11, 2016. However, the section relating to online gambling was left in limbo, as the bill contained errors that needed correcting before internet gaming could be officially authorised.

On January 15, 2019, the Michigan Gaming Control Board (MGCB) held a meeting to discuss the regulatory framework for internet gaming and sports betting. It was agreed that the MGCB would draw up emergency rules to take effect 28 days after publication in the Official State Bulletin.

On February 4, 2019, the MGCB published the rules in the Official State Bulletin. The regulatory emergency was ratified on March 22, laying the groundwork for operators to apply for a licence.

On June 11, 2019, Gov. Whitmer signed legislation to regulate sports betting in Michigan. The bills were signed into law on December 20, 2019, allowing the MGCB to draw up sport betting rules ahead of the first licences being issued in 2020.
